TERMS AND CONDITIONS

1. DESCRIPTION OF OPEN WATER SWIMMING TOURS
SwiminGreece provides escorted open water swimming tours to all interested fit and healthy adult persons or accompanied minors of at least 16 years of age. The open water swimming locations are in selected Greek islands, and the participants may choose one location per tour. The swimming sessions are supervised by English speaking trained professionals with lifeguard and First Aid qualification and experience. Swimmers are escorted by one main boat steered by an experienced boat captain and by smaller regular or inflatable boat/s or equivalent.
2. TRIP ARRANGEMENTS
SwiminGreece is specialized in providing open water swimming tours only. Travelling, accommodation and other tourist arrangements are provided by independent tour operators. SwiminGreece will provide directly to you all necessary information regarding tour operators, in order to facilitate your travel arrangements.
3. PREREQUISITES – REQUIREMENTS OF BOOKING - PARTICIPANTS' RESPONSIBILITIES
Open water swimming is an activity conducted on each participant’s risk. Therefore, in order to participate in our tours, all participants have to state upon booking, by signing the relevant Booking Form, that they are responsible for checking their health status prior to the tour and to ensure that their physical and medical condition and swimming experience are appropriate for following open water swimming activities. Nevertheless, in order to prevent mishaps, our office reserves the right to decline a swimmer’s participation if he/she is considered unfit for the swimming tours, even after the trip has started. Moreover, it is strongly advised that participants should inform SwiminGreece - by filling in the relevant field in the Booking Form - if there is any medical condition that should be taken special care of.
In addition, all participants have to provide open water swimming (or equivalent) travel, health, accident and repatriation insurance cover prior to the start of the tour, as per the instructions given on our web page. In case insurance arrangements are not met per our instructions, SwiminGreece will be obliged to cancel the booking as invalid or make other arrangements, e.g. give the swimmer the right to participate in another group, if possible, after insurance cover arrangements are duly met.
If a participant makes all travel arrangements personally and not in cooperation with a travel agency, he/she has to insure that he/she has a valid passport and visa (if required) for entry into the Country of destination.
Finally, each participant undertakes the responsibility to follow the rules provided by legislation or by authorities, and/or the instructions or any other regulations set forth by our tour supervisors, guides, lifeguards, boat captains, so as to avoid illegal conduct and/or any unfit or dangerous behavior to him/herself, other participants or third parties in general. In case of substantial breach of such responsibility, according to our judgment and discretion, SwiminGreece reserves the right to terminate without previous notice a member’s participation, without any refund or compensation.
4. BOOKING – DEPOSIT AND OUTSTANDING BALANCE PAYMENT
Each participant has to visit our web site, chose his/her preferred tour date from the choices given, fill in and submit the Tour Inquiry Form available. Upon receipt of such Inquiry Form, duly filled in, each participant will be notified from our office, by email, at the given address, of the total cost of the trip and with all details how to proceed with deposit payment and insurance coverage. One document consisting of a Booking Form, and of our Terms and Conditions, is to be found attached to such email. The participant has to follow the instructions given in order to send such Booking Form, duly filled in and signed, back to us.
Deposit amounts to 20% of the total cost of the tour and is non refundable. Upon its receipt a binding contract between the participant and SwiminGreece comes into effect. Moreover, upon receipt of deposit, the participant’s place in the tour is reserved. Once a booking is made, each participant will receive information by email how to prepare a suggested kit list. A trip itinerary and contact details will be also sent by email, prior to departure.
The outstanding balance is due 6 weeks prior to the start of the tour. If a booking is made within 6 weeks prior to the start of the tour, then the whole balance is due on the day of booking. All necessary information in respect of outstanding balance payment will be sent to you via email. If we do not receive payment by the Due Date, we reserve the right to cancel your booking immediately and you will forfeit your Deposit.
5. ITINERARY AMENDMENTS
SwiminGreece, in liaison with our boat captains, reserves the right to alter swim routes and itineraries in light of weather conditions for safety reasons.
6. CANCELLATION OF TRIP BY PARTICIPANTS OR BY SWIMINGREECE - CONSEQUENCES
A participant has the right to cancel his/her booking prior to the start of the tour by written notice sent via email. If such an event occurs, for cancellation notice received up to 6 weeks prior to the start of the trip the participant loses 20% of the total cost of the tour (the deposit money). For cancellation notice received 4-6 weeks prior to the start of the tour the participant loses 50% of the total cost of the tour, for cancellation notice received 4 weeks to 30 days prior to the start of the tour the participant loses 75% of the total cost of the tour and if cancellation notice is received 0 - 30 days prior to the start of the tour, the full amount of the cost tour fee will be retained.
Our office reserves the right of cancellation of the trip at any time for reasons of force majeure (or circumstances beyond our control). Such reasons include (but they are not limited to) weather conditions, strikes affecting trip arrangements, war or riot conditions. In this case, we shall not be liable to you for any losses or compensation.
We also reserve the right of cancellation at any time if an insufficient number of participants make the trip impossible, according to our judgment. In this case of cancellation, you will be offered a choice of either a full refund for the tour or an alternative tour within the same calendar year. Furthermore, we will not be responsible to cover any other losses, including travel arrangement prepayments or deposits of any kind.
7. PERSONAL DATA
All personal data disclosed to us in any way whatsoever is not kept, stored or used in any way whatsoever. It is considered private and confidential and protected by legislation, especially all details concerning your medical and health condition. That is why we take for granted that upon receipt of your data, we have your explicit consent to disclose to us your private and confidential information only to your benefit and protection.
Moreover, we take for granted that we have your explicit consent to disclose some personal data (e.g. your name, address, contact information e-mail address etc.), if needed, to travel agents, hotels etc. on our discretion to make all necessary arrangements for your trip.
Any other data, including videos or photographs of your open water swimming tours may be used for advertising or marketing purposes of SwiminGreece unless otherwise advised.
8. LIMITATIONS OF LIABILITY
SwiminGreece shall not be held liable for any discomfort, inconvenience, loss, injury or damage due to neglect, act or omission caused by the participant himself or any third party whatsoever (e.g. suppliers, tour operators, accommodation providers or any other third party, person or legal entity) or by unavoidable or unforeseeable circumstances or reasons of force majeure.
9. LAW AND JURISDICTION
This contract is governed by Greek legislation and any dispute arising belongs to the jurisdiction and competence of the Courts of Athens.
